In compliance with the Federal Law on Protection of Personal Data in Possession of Private Parties (“Law”) and its Regulation, we inform you the following:

PRIVACY NOTICE

Identity and Responsible´s Address.

Fevisa Industrial, S.A. de C.V. ( “Company”), located at San Felipe Highway 9th kilometer, Colorado I, zip code 21740,  Mexicali B.C., is responsible for the use of the personal data (“Personal Data”) collected from you as Owner thereof (“Owner”), or by-product of any relation, legal or of any kind whatsoever with the Owner, including any labor relations,  commercial relations, in any of its stages, probable, negotiation, or current.

Possible Personal Data uses.

The Personal Data requested from you, in accordance with the Owner and the Company´s relationship, include:

1) Name;

2) Age;

3) Gender;

4) Address;

5) Marital status;

6) Place and date of birth;

7) Telephone and/or cellphone number, and/or any other number where you can be contacted; 8) Nationality;

9) E-mail;

10) Unique Population Registry Code (CURP – Clave Única de Registro de Población);

11) Registry number from the Federal Taxpayer´s Registry (RFC – Registro Federal de Contribuyentes); 12) Affiliation number from the Mexican Social Security Institute;

13) Academic and employment information;

14) Migration data, if necessary.

The Company informs the Owner that the first can request any document containing Personal Data as categorized in the  previous list. Also, the Company may use personal data collected from relatives (ascendants, descendants), dependents,  representative or attorney-in-fact of the Owner, of which the Owner acknowledges to possess their consent so that the  Company may use the data and fulfill its duties.

Possible Sensitive Personal Data uses.

The Company informs that, in order to correctly identify the Owners, and the endeavors and development of the relationship  between the Company and the Owner, the Company may use Sensitive Personal Data shared under the Owner´s sole discretion, which may include: health condition (physical, mental, and emotional), aptitudes and abilities and financial  information.

 

Purpose of the Use.

The Owner´s Personal Data will be used for the following necessary purposes, notwithstanding any other purpose  aforementioned in this Privacy Notice, that creates, and for the maintenance and compliance of the existent or possible legal  relationship with the Company:

 

Primary or Necessary Purposes for a Labor Relationship.

1) Fulfill the previously established recruitment process;

2) Identify the Owner as a candidate for an employee position in the Company and keep up to date its file with human  resources;

3) Contact the Owner in the event of a job opening suited to its profile as a candidate;

4) Contact the Owner for labor purposes;

5) Send job offers or information to the Owner about its labor or services relationship with the Company, including applicable policies and regulation;

6) Create databases (including databases regarding collected sensible data) for administrative and human resources  purposes;

7) Give the Owner information required by entities or governmental authorities, or in compliance with laws or statutes  applicable to the business of the Company in the United Mexican States or in foreign territory;

8) Assess any complaint, question or comment made by you;

Primary or Necessary Purposes for a Commercial Relationship.

1) Comply and fulfill contractual obligations between the Company and you;

2) Create quotations of our products;

3) Develop commercial and business proposals;

4) Work to secure services of its products or services, and secure payments;

5) Create databases for administrative and organizational purposes;

6) Give information required by entities or governmental authorities, or in compliance with laws or statutes  applicable to the business of the Company in the United Mexican States or in foreign territory;

7) Assess and follow up on any complaint, question, comment, or contact request made by you;  8) Monitor and preserve the security of our facilities and our personnel; and

9) Notify the Owner in case modifications are made to this privacy notice.

Secondary or Unnecessary Purposes.

Additionally, the Owner´s Personal Data will be used for the following unnecessary purposes:

1) To send information regarding the Company;

2) Send information, magazines, and news of our industry or information we consider it may be of interest, such as  news, communications, or Company´s publicity;

3) Give its information to third parties interested in making business, granting financing, acquiring the shares or  assets of the Company, and

4) Create databases for investigation, statistics, or marketing purposes, and to measure the quality of services of the   Company.

How do we Preserve your Personal Data?

Your Personal Data will be used following all administrative, physical, and technical security measures established by the  Law and its Regulation, to prevent its damage, loss, destruction, theft, alteration, and/or unauthorized use.

The Company on its own may keep your Personal Data in databases located in the United Mexican States or in foreign  territory, without any reservations, except under the terms established by the applicable legislation, and to comply with the  purposes established in this privacy notice, the Law, its Regulation, and other applicable statutes.

In the event of any legal relationship, past or present, between the Owner and the Company, we will keep

its Personal Data for as long as any applicable law requires it, however, when its Personal Data become  unnecessary, it will be safely eliminated from our databases. Likewise, in the event of being a candidate to  fill a job position in the Company, we inform you that in case of not being selected for such, we will withhold  your information for a duration of 6 months in our database, for the sole purpose of having a reference for  our personnel contracting process, and to be able to contact you for future employment opportunities.

We inform you that given electronic communications are not totally secure and that every informational system is exposed  to possible vulnerabilities that may affect its proper functioning or security; the Company cannot guarantee there will be no  damage, loss, destruction, alterations, or unauthorized use. We will comply with all administrative, physical, and technical  security measures in accordance with data protection regulation and any other corresponding statutes.

Privacy Notice Acceptance.

As soon as Personal Data is shared with the Company through its webpage www.fevisaglass.com, you accept the terms of  this Privacy Notice, and you give your explicit consent for us to use said sensitive and financial Personal Data. If you choose not to give your explicit consent for us to use your (sensitive and financial) Personal Data, we are forced to rescind any job  offered to you (in case of job applicants) and forego any business or commercial relationship.

ARCO Rights, of Nullification, Limited use and/or revelation of Personal Data.

The Owner may limit the use or revelation of Personal Data, and exercise any of its rights to access, rectification,  cancellation, opposition (“ARCO Rights”) and/or nullification regarding the Company’s Use of Personal Data, by contacting  our Human Resources Department through [email protected], and/or 686-9045400, extension 2280 or 2281.

The Department of Human Resources will grant you access to Exhibit 1´s format “Rights to Access, Rectification,  Cancellation, Opposition, Revocation and Limitation of Use and/or Revelation of Personal Data Petition”, to facilitate your  exercise of the aforementioned rights.

In terms of the Law, any request to exercise the aforementioned rights must necessarily indicate:

1) Name and Address,

2) Copy of an official identification (passport, driver´s license, voting card),

3) A clear and accurate description of the Personal Data you request access to, or its rectification, cancellation, or  opposition, and add any other piece of information that may facilitate the location thereof.

4) Any other requirement established by Law and/or other applicable legislation.

The Company will respond to any requests made within the next 20 business days or within the maximum term established  by Law. The Company´s answer will indicate if the request to access, rectify, cancel, or oppose is admissible, and if so, said determination will be enforced within the next 15 business days you or your representative become aware thereof. The terms  may be prolonged when provided for by Law. We will grant electronic copies of your personal information whenever you  exercise your right to access.

Personal Data Assignation.

As part of the internal administration of our Company, we can assign your Personal Data to all or any of the companies  associated to the same economic group on a local, regional, or nation level, and on foreign territory if these manage under  the same internal policies and processes; under these terms the Company may assign your data without authorization.

The Company may share Personal Data to third parties such as attorneys, accountants, and service providers that use Personal Data on  behalf of the Company under our specific instructions.

 

The Company does not require posterior consent from the Owner for these assignations, since it became explicitly consented  by the Owner when it accepted this Privacy Notice. Notwithstanding, the Company will not share or assign your Personal  Data to third parties except when provided by the Law or other applicable statute. In certain situations, and on limited  activities endeavored by the Owner and the Company, the latter may request the former its consent to assign Data to a  different receptor to the aforementioned. Nevertheless, the Company will share with any Personal Data receptor, this Privacy  Notice, and the receptor will be obliged to use as such thereof.

Notification for changes to the Privacy Notice.

The Company will inform the Owner about any change to this Privacy Notice through notifications made in the webpage  www.fevisaglass.com, likewise, it will be notified through the email address given to the Company.
